Little Wold Vineyard, and its subsidiary Market Place Farm Ltd ("Little Wold Vineyard" or "we") provides its content on this website (the "Site" and "Site Content") subject to the following terms and conditions (the "Terms"). We may periodically change the Terms, so please check back from time to time. These Terms were last updated on 16th March 2022. By accessing and using this Site, you agree to these Terms. 


COVID-19

As of 24th Feb 2022, it is no longer a legal requirement for people to self isolate when they test positive for covid.


What are we doing to keep our guests safe?


Age Restrictions

It is an offence for persons under the age of 18 to purchase alcohol. By placing an order you confirm that you are over 18 years old. Little Wold Vineyard reserves the right to pass on purchaser information to third parties where this is required by law.


Customer Satisfaction

Little Wold Vineyard is dedicated to providing a high level of customer service. If you are dissatisfied with our products or services in any way, please do not hesitate to contact us using the information on our ‘Contact’ page. We shall endeavour to address any issues as soon as possible.


Security

We take your security very seriously. All order information is sent to us online via a secure server that uses secure SSL encryption technology to protect your card details. Your card details are not held either on our own internal systems or on the Internet. The registration and transaction processes are consequently safe.


Date Protection Privacy Statement

Little Wold Vineyard is committed to protecting your privacy. Any information collected about you, either during the registration or transaction processes, will only be used lawfully and in accordance with the Data Protection Act 1998.

We use software on the website that collects statistics, such as how many people are visiting the site, which pages they are looking at and how long they are spending on the site. This information is anonymous and is used only in order for us to understand visitor needs and improve the site.

No information provided during the registration or transaction processes will be passed on to any third party or used for marketing purposes, unless specifically permitted by the registered user or customer.

Our website may contain links to other websites of interest. Little Wold Vineyard has no control over the content of these sites, and are no longer responsible for the protection and privacy of any information which you provide having left our site by following any of these links. As such the use of these websites is not governed by this privacy statement.

When you visit some areas of our website, a “cookie” will be placed on your computer. This is a small file that enables our site to improve the quality of your visit. You may be able to set your browser to reject cookies, although this may affect the quality of your visit.

Little Wold Vineyard may use your email address if you purchase a tour or an adoption package on our shop. Your email address will only be used by us for communication purposes such as tour information, vineyard events, harvests and general newsletters. You can choose to stop receiving such communication at any point by unsubscribing at the bottom of the email or by contacting us. We will not sell on your private details and we only keep these for our communication purposes.  


Products and Availability

All items are subject to availability.  In the event that goods you have ordered are not in stock we will contact you by email as soon as possible.


Delivery

We use a courier company to deliver orders. The courier will require a signature on delivery, if you are unlikely to be at home you might prefer to use your work address. Alternatively, you might be carded leading to possible delays or, in the worst case, having to collect from your nearest depot. In the unlikely event that delivery is delayed, due to no fault of our own, we cannot accept responsibility for that delay.


Claims

Claims for breakages or other damage must be made to the carrier at time of receipt and followed up in writing or by email to Little Wold Vineyard within three days of receipt. We are unfortunately unable to offer refunds on orders if we have not been notified within this time period.


Methods of payment

We accept Visa, Mastercard, Visa Electron and Maestro (Switch) and payment by Paypal. If you are paying by Maestro you will also need to include the card issue number or start date. We only take online payments and therefore cannot take any payment over the phone.

The total cost of your order is the price of the products plus delivery charges. All orders are positively credit card sanctioned prior to dispatch, so please ensure that the details you provide us with are correct. We cannot accept responsibility for an order being held back as a result of incorrect or invalid payment details being supplied.


Copyrights

All content and functionality on the Site, including text, graphics, logos, icons and images and the selection and arrangement thereof is the exclusive property of Little Wold Vineyard or its licensors and is protected by English and international copyright laws. All rights not expressly granted are reserved.


Trademarks

The trademarks, service marks, designs and logos (collectively, the "Trademarks") displayed on the Site are the Trademarks of Little Wold Vineyard and its licensors. You agree that you will not refer to or attribute any information to Little Wold Vineyard or its licensors in any public medium (eg press release, websites) for advertising or promotional purposes, or for the purpose of informing or influencing any third party, and that you will not use or reproduce any Trademark of, or imply any endorsement by or relationship with, Little Wold Vineyard or its licensors.


Use of Site Content

The unauthorized modification (including deleting from or adding to) of this website is strictly prohibited. We cannot be held responsible for the content of any other website to which we publish a link. Little Wold Vineyard makes every effort to ensure that this website is free from viruses and defects. We cannot, however, guarantee that your use of this website will not cause damage to your PC, laptop, ipod, iphone, smartphone or other such device. We cannot accept responsibility for any loss or damage which may arise as a result of using this website. This website may only be used for lawful purposes and in a manner which does not infringe the rights or restrict the use of the website by any third party. Any unauthorized attempt to disrupt the service provided by this website is strictly prohibited.

Cancellation Policy

We operate a policy for cancellation to allow you a cooling off period after placing your order. In accordance with the Distance Selling Directive (2000) you may cancel your order at any time without reason within 7 working days of delivery.

You may cancel your order for any reason provided:

You, or the recipient, notifies us of your cancellation in writing/email to the address on our ‘Contact’ page within 7 working days of delivery.

The goods remain unused and the packages or boxes remain unopened. You, or the recipient, retain and take responsible care of the goods until you return them.

You return packaged item(s) to Returns at Little Wold Vineyard to the address on the ’Contact’ page. Please note you will be liable for the original and any postage/carrier costs incurred as a result of returning items to Little Wold Vineyard and you should ensure that you obtain proof of despatch as you send it back. A refund can only be provided for items received back by us in perfect condition.


Governing Law

These Terms and conditions are governed by and shall be constructed in accordance with the Laws of England and under the jurisdiction of the English Courts.

Tours & Tasting Events

Terms & Conditions


1. Contract


1.1 These Terms and Conditions shall apply to tours and tasting events and be incorporated and prevail over any other terms and conditions in respect of any tours and tastings supplied by Little Wold Vineyard


1.2 The purchaser of a tour or tasting event is required to agree to these Conditions at the point of purchase. Any individual purchasing a tour or tasting event for a third party shall be deemed to be acting with consent of each guest for whom they are making the purchase, including acting with the authority of each guest to agree to these Terms and Conditions on their behalf.


1.3 We may amend these terms from time to time by placing appropriate notification on this page.


2. Tour / Event Guest’s Rights and Obligations


2.1 The Tour / Event Guest or Voucher Holder must book and/or attend their experience by no later than the date shown on their voucher (this will appear on the voucher as either a ‘Valid To’ date, or as an ‘Expiry’ date. 


2.2 The Tour / Event Guest shall only be permitted to access areas of the vineyard and tasting room that form part of the Tour or Event and the Guest agrees not to access any other area of our farm land. 


2.3 The Tour / Event Guest hereby agrees:


2.3.1 not to carry out any activity whilst in the vicinity of the vineyard which is damaging, dangerous, offensive, noxious, illegal or immoral or which is or may become a nuisance to Little Wold Vineyard or other visitors to the farm.


2.3.2 not to bring into Little Wold Vineyard any animals (with the exception of guide dogs) or any food, drink or litter; and


2.3.3 to comply with all instructions of any Employee and/or Tour Guide of Little Wold Vineyard.


3. Little Wold Vineyard’s rights and obligations


3.1 Little Wold Vineyard shall have the right to prevent access to or remove from the premises and/or Tour:


3.1.1 any Tour / Event Guest acting in a way which in the opinion of Little Wold Vineyard (in its absolute discretion) is unacceptable or reasonably likely to cause damage or injury to either the Guest or any other visitor (including drunken, harmful, offensive, threatening, disrespectful or violent behaviour);


3.1.2 any Tour / Event Guest who is breach of any of the Conditions; without any liability to the Tour / Event Guest by way of compensation, refund, re-admission or otherwise.


3.2 We reserve the right to increase the price of the goods from time to time, notice of which will be placed on our Website.


3.3 We reserve the right to change the type of wine included in the tour and/or tasting event according to our availability without notice to the Guest.


4. Tour / Event Guest’s visit


4.1 The Guest should arrive no later than 10 minutes before the allocated start time for their Tour or Event and should report to the tour guide/tasting room upon arrival. If the Tour Guest fails to arrive

by the allocated start time Little Wold Vineyard cannot guarantee that an alternative day/time will be available. Little Wold Vineyard shall make reasonable efforts to transfer the Tour Guest’s Booking or Group Booking to an alternative day/time but, whether or not this is done, Little Wold Vineyard shall not be liable to the Tour Guest for a refund or any other compensation.


4.2 Tours vary in length and Tour Guests may be outside in the vineyard for considerable time and some walking is required.


4.3 The Tour Guest shall only be entitled to take photographs and/or video recordings in the Vineyard for bone fide private and non-commercial purposes.


4.4 The Tour Guest shall be solely responsible for his/her personal property and Little Wold Vineyard shall not be liable for loss of or damage to such personal possessions.


5. Suspension and/or termination by Little Wold Vineyard


5.1 Due to the operational needs of Little Wold Vineyard in the undertaking of its business as a wine producer, Little Wold Vineyard may be required to act on short notice (i.e. when there is a late change of operations) and Little Wold Vineyard shall have the right, at its sole discretion, to:


5.1.1 suspend or cancel the Tour; and/or


5.1.2 close the whole of the farm where considered necessary, whether for operational reasons or otherwise. In such circumstances Little Wold Vineyard shall endeavour to provide notice to the Tour Guest (if reasonably possible and where contact details are available) of such suspension, cancellation or closure and the Tour Guest shall be entitled (at its own discretion) to accept an alternative date/time or to receive a refund. No further compensation shall be payable by Little Wold Vineyard.


5.2 In the event that Little Wold Vineyard provides the Tour Guest with an alternative date/time for the Tour and this is accepted by the Tour Guest, Little Wold Vineyard’s obligations to the Tour Guest shall cease and it shall have no further liability.


5.3 In the event that Little Wold Vineyard refunds the Tour Guest’s Booking, Little Wold Vineyard’s obligations to the Tour Guest shall cease and it shall have no further liability to the Tour Guest. For the avoidance of doubt, the refund referred to in this Condition shall be the price paid by the purchaser (for and on behalf of the Tour Guest) at the time of the Booking.


6. Cancellation by the Tour Guest


6.1 The Tour Guest shall have the right to cancel an advance Booking, where payment has been made, but it shall not be entitled to a refund. If the Tour Guest requests an alternative date/time, Little Wold Vineyard must be made aware with a minimum 28 days notice to the event date. If sufficient notice has been given, we shall make reasonable efforts (subject to availability) to rearrange the Tour Guest’s Booking but shall not provide any guarantee to this effect or incur any liability to the Tour Guest for its failure to do so.


6.2 Should it be necessary to cancel or change your booking we require notice within 7 days of the booking being made and no later. 


6.3 If the Tour Guest cancels a Group Booking, Little Wold Vineyard shall be entitled to retain any deposit paid by (or on behalf of) the Tour Guest at the time of the Group Booking, but the Tour Guest shall not be required to pay the remaining balance. The Tour Guest may request an alternative date/time for the Group Booking, subject to the terms of Condition 6.1, and shall be entitled to use the original deposit against that alternative date/time for a Group Booking.


7. Liability


7.1 The Tour Guest shall be liable for all costs, losses and liabilities incurred by Little Wold Vineyard as a result of any damage to its property caused by the Tour Guest and/or any actions of the Tour Guest.


7.2 Subject to Condition 7.4, Little Wold Vineyard’s total aggregate liability to the Tour Guest for any cause of action arising out of or in connection with the Contract (whether for breach of contract, strict liability, tort (including negligence), misrepresentation or otherwise) shall not exceed the price paid by (or on behalf of) the Tour Guest for the Tour.


7.3 Subject to Condition 7.4, Little Wold Vineyard shall have no liability whatsoever for any indirect, special, consequential or exemplary loss or damage incurred by the Tour Guest (including, but not limited to, any travel and accommodation costs) arising out of or in connection with the Booking or Group Booking or the suspension or cancellation of the Booking or Group Booking by Little Wold Vineyard pursuant to Condition 7, whether or not the Tour Guest knew or should have known of the possibility of such loss or damage.


7.4 Nothing in the Contract shall limit or exclude Little Wold Vineyard’s liability for:


7.4.1 death or personal injury caused by its negligence; or


7.4.2 fraudulent misrepresentation.


8. Warranties and indemnities


8.1 All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from the Contract.


8.2 The Tour Guest shall indemnify Little Wold Vineyard against all liabilities, costs, expenses, damages and losses (including any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal and other professional costs and expenses) suffered or incurred by Little Wold Vineyard (including in respect of any third party claim brought against Little Wold Vineyard) and arising out of or in connection with any actions of, or damage caused by, the Tour Guest.


9. General


9.1 Little Wold Vineyard shall have no liability to the Tour Guest under the Contract if it is prevented from, or delayed in performing, its obligations under the Contract or from carrying on its business by acts, events, omissions or accidents beyond its reasonable control.


9.2 No variation of the Contract or the Conditions shall be valid unless it is in writing and signed by or on behalf of both Little Wold Vineyard and the Tour Guest.


9.3 Notwithstanding that any provision of the Contract may prove to be illegal or unenforceable, the remaining provisions of the Contract shall continue in full force and effect.


9.4 The Contract shall be construed and performed in all respects in accordance with the laws of England and each party agrees to submit to the exclusive jurisdiction of the English courts.


9.5 The images, digital copies, descriptive matter and specifications of the goods contained on the Website are posted for the sole purpose of giving an approximate idea of the goods and you acknowledge that there may be slight differences. They will not form part of this Contract.


9.6 Unless otherwise expressly stated in these Terms and Conditions, all notices from you to us must be in writing and sent to our registered address at Little Wold Vineyard.


10. Tour Vouchers including discounts or Tasting Room spend


10.1. Tour Vouchers including discounts, offers or Tasting Room Spend are subject to the following terms:


10.1.1. Discount included in vouchers (e.g. Christmas Edition Vouchers) is valid only for the purchase of wine bottles or cases at the Tasting Room. The discount can't combine with other discounts, offers or gift cards.


10.1.2. Tasting Room Spend included in vouchers is valid for the purchase of any item, product or service sold at the Online Shop. Exclusions may apply.


10.2. Discounts or Tasting Room Spend are valid only the day of the tour, and are not valid for online transactions. 


10.3. Any offer, discount or value included in a voucher is non-refundable and cannot be exchanged for cash in part or full and is valid for a single transaction only.
